Our general rule of thumb: If paying for something will lead to money in the pockets of the people who made it, you should probably pay for it. As Jim Gibson, law professor and founder of the Intellectual Property Institute at the University of Richmond School of Law, put it to us: “Whether its wrong or not, in a moral sense, is something you can ask your friends or your minister. But whether its illegal from a copyright viewpoint, the best answer is, probably not on an individual viewer basis. ” Watching a stream of unlicensed movies, TV and sporting events is legal Any discussion of the legality of streaming in the U. S. begins with the Copyright Act of 1976. This grants copyright holders “exclusive rights” to make copies of their work, distribute it and perform it publicly. And watching a stream — even if its unauthorized by the copyright holder — doesnt technically violate these rights. There have been numerous challenges and interpretations as copyright law has adapted to the internet, but this reading has essentially held true. “I think the best interpretation of copyright law is that its not illegal to watch unlicensed content, ” Gibson said. “The person whos merely watching a stream should incur no copyright liability from that act alone. ” Watching a stream doesnt constitute public performance “Copyright attaches liability only to public performances, and streams arent public performances, ” Gibson said. “Streams are performances, but theyre not public if its just you in the privacy of your own home and youre not making a permanent copy — you start it and you stop it and thats your only interaction with it. ” Nicole Haff, partner and head of litigation at Romano Law PLLC, a firm focused on business, media, sports and entertainment law, agreed with this interpretation. “I think it would be a hard argument to say that somebody watching a streamed video is publicly performing the video, ” she said. “Theyre not the one putting it out there, theyre actually receiving it. ” “Pseudo-streaming” doesnt count as making a copy One of the most common arguments for unlicensed streaming violating copyright law is that streams actually do create copies of the work in order to act as a buffer so your stream remains uninterrupted. This is technically known as a “ progressive download, ” but more commonly called “pseudo-streaming. ” However, the pseudo-streaming argument hasnt held up in court. “Copyright doesnt care about versions of the work that are so transitory that they almost immediately disappear upon consumption, ” Gibson explained. “Thats not a copy under the laws definition. ” The U. Copyright Office itself basically conceded the impossibility of pinning this point down in its 2001 report on the Digital Millennium Copyright Act: “How temporary is temporary? Hours? Minutes? Seconds? Nanoseconds? The line would be difficult to draw, both in theory and as a matter of proof in litigation. ” Its highly open to interpretation, and so far, those interpretations have been that streaming does not equal making a copy. “The cases basically say, “Thats not what were talking about when were talking about a permanent copy, ” Gibson said. “If youre really doing real-time streaming and no lasting, accessible copy ends up on your computer, then YouTube might be liable, and the original uploader might be liable, but the person watching the stream almost certainly is not. ” Peer-to-peer streaming There is one type of unauthorized streaming that could get you into trouble: Peer-to-peer streaming services like BitTorrent Live. Like torrents, these services rely on users to share the content. If youre a viewer, youre also a broadcaster, which does violate copyright law. “If I access that stream via a peer-to-peer streaming service that I know is not legal because Im uploading unauthorized content in order to access other unauthorized copies, then yes, I can get in trouble for participating in streaming in that way, ” Joy Butler, attorney and author of The Permission Seekers Guide Through the Legal Jungle, told us. But these types of peer-to-peer streaming networks arent all that common right now, and you typically have to opt in by clicking “Allow” before joining a stream. Its unlikely that someone would unwittingly join one. Downloading unlicensed content is always illegal While streaming doesnt violate U. copyright law, downloading very explicitly does. Youre making a copy of the work every time you download something — a clear violation if its done without the copyright holders permission. “The copyright owner has the exclusive right to make copies. Thats why we call it the ‘copyright, ” Gibson explained. “So if youre making a copy that is some sort of permanent version of a work, then even if you do it in the privacy of your own home, you may well be liable. ” That said, while theres no debate on whether or not its illegal to download unlicensed content, ordinary users are unlikely to face legal consequences. “I think in most cases, the copyright owners going to want to pursue the person whos actually uploading the content, ” Butler said. “In the music industry, pursuing individual listeners to content was not very effective and it was not very popular from a P. R. standpoint. ” Gibson echoed those comments, telling us, “There was a time when the recording industry and to some extent, the movie industry, was actually targeting those who simply downloaded illegally for their own enjoyment. But they basically havent been doing that for a good eight or nine years. ” “This is not to say its OK to do. If you download, you are very likely infringing copyright and shouldnt do it. But your practical likelihood of getting sued is pretty low if youre just an individual downloading for your own consumption” BitTorrent users are more likely to be sued BitTorrent is an exception. Downloading through torrents adds another layer of wrongdoing, as youre also distributing the content every time you download. Legal action is much more common in these cases. “Companies will go after BitTorrent users, ” Haff said. “Because you have to. By using it, youre also uploading it. So youre also contributing to the problem. ” Indeed, BitTorrent lawsuits have become something of a cottage industry in recent years, with an estimated 3, 000 suits filed by copyright holders in 2018 alone. The chances that youll be sued are still slim, but its much more likely than with other downloading methods. Hosting an unauthorized stream is illegal — and more likely to be pursued legally While watching an unauthorized stream is legal, hosting one is not — and its much more likely to draw attention from copyright holders. “What they really want to know is whos putting the content out there. Because thats the bigger fish to fry, ” Haff said. “So many Americans illegally stream, you would be in endless litigation. ” Hosting an unauthorized stream falls under the distribution portion of the Copyright Act, but the criminal penalties are limited to misdemeanors, as opposed to felonies for downloading. “The maximum penalty is essentially a year in prison and a 100, 000 fine — or twice the monetary gain or loss, ” Haff said. In the past, the government has attempted to make penalties for hosting illegal streams more commensurate with downloading. In 2011, the Commercial Felony Streaming Act was introduced to the Senate. It would have made hosting illegal streams for the purpose of “commercial advantage or personal financial gain” a felony with up to five years in prison. The bill faced significant backlash from the public, most notably from streamers on YouTube. There was even a “Free Bieber” campaign started by the pop singers fans, who worried that the covers of copyrighted songs that launched his career could put him behind bars if the bill passed. Ultimately, that outcry was enough; the bill was never even voted on. Today, hosting an unauthorized stream remains a misdemeanor in the U. S., although civil damages are more likely in most cases. Copyright enforcement is almost always civil, not criminal While there are harsh penalties in place for illegal streaming and downloading, youre much more likely to face action from the copyright holders themselves than the government. “The vast, vast majority of copyright enforcement is civil, ” Gibson told us. “Theres a very small number of criminal copyright prosecutions each year. I think the numbers probably around 100. They tend to be against large-scale, commercial piracy operations. ” “Ive never heard of a criminal prosecution for personal use downloading, infringing though it might be. So that big FBI warning, its mostly just to scare people rather than present them with a realistic scenario of what might happen. ” Image credit: The Hollywood Reporter Even if streaming is legal, viruses are still a concern For many people, computer viruses from less-than-reputable streaming sites are as strong a deterrent as legal action. If a site is willing to break the law to host pirated content, its fair to assume that it wont stop there. Heres what the Federal Trade Commission says on the topic: “Purveyors of pirated content are now spreading apps and add-ons that work with popular streaming devices. If you download one of these illegal pirate apps or add-ons, the chances are good that youll also download malware. ” Thats not necessarily as alarmist as it might sound. According to a 2015 report by the non-profit Digital Citizens Alliance, about one-third of illegal streaming sites exposed users to malware. The report estimates that these sites make around 70 million per year this way. “Its clear that the criminals who exploit stolen content have diversified to make more money by baiting consumers to view videos and songs and then stealing their IDs and financial information, ” said Tom Galvin, Executive Director of the Digital Citizens Alliance. Following best practices for internet safety can go a long way in protecting you from malware, but using illegal streaming sites will always present a significant risk. The bottom line If youre simply watching a stream of unlicensed content, youre not technically breaking the law. Where it becomes a crime is if you download the movie or show, or host a stream yourself. But just because you can doesnt mean you should. We liked the way Jim Gibson put it to us: “The fact that somethings legal or the fact that somethings illegal but unlikely to result in a lawsuit, doesnt necessarily tell us whats right and wrong. People have to have their own moral compass about the kind of conduct in which they engage when it comes to copyrighted works. ”.

Anya Morgante of Toronto says she cant believe shes being sued for allegedly sharing a copy of a film featuring Ryan Reynolds and Samuel L. Jackson. “I am not a pirate, ” she said, a term often used to describe people who share copyrighted works like movies without permission or payment. But Morgante is just one of about 3, 400 Canadians facing legal actions in Federal Court launched by a prestigious Toronto law firm on behalf of U. S. movie production companies attempting to enforce their copyright claims. “There is no such thing as a free lunch, ” said lawyer Ken Clark, a partner at Aird & Berlis LLP, who is spearheading the litigation. “If you get caught, you have to pay, ” he said. Story continues below advertisement One of Clarks clients, Bodyguard Productions, Inc., made the Hollywood film The Hitmans Bodyguard, described as a “genuine smash hit” by Forbes Magazine, earning more than US70 million when it was released in 2017, according to the publication. But producers and distributors said they believe they have lost significant additional revenue to video pirates who are sharing the movie online for free in violation of copyright legislation, including Canadas Copyright Act. “We are trying to educate people and make it sting a little, ” Clark told Global News, describing how his law firm is methodically sending out hundreds of legal claims against Canadians who shared the movie. Clarks law firm sent Morgante a statement of claim in December, 2017, alleging infringement after the movie was shared through her Rogers internet service. The claim has not been proven in court. “Its been stressful, ” Morgante said in an interview, denying she watched or shared the movie. However, she acknowledged it was possible someone else in her home or someone who had access to Wi-Fi service did. “Im not even computer-savvy, ” said Morgante, adding she did not receive any notice from Rogers alleging her account had been used improperly. Clark said his client isnt interested in going after those who merely download video content, but internet users who shared videos with others — something detected by sophisticated sniffer software used by movie companies. “We send warning notices for a reason: to put the owner of the (internet) account on notice, ” he said, adding they would not take legal action against anyone who had not received at least two emailed warnings first. He said they would only take action if the person in question ignored the warnings. In response to the claim, Morgante said she got advice from a legal clinic and then submitted a statement of defence. She said she didnt share the movie, nor does she believe anyone else in her household did. Television Can Be Expensive (It Doesnt Have To Be) O ne way that my wife and I have saved money over the years is that while most of our friends have cable or satellite TV, weve never paid subscription costs to receive TV programming. We like to watch TV free. That means that we are saving ourselves a good chunk of money every year.  If youre in debt, you probably shouldnt be paying for TV either! Rates for cable in our area range anywhere from around 12/month for the basic package with only local channels to well over 100/month for upgraded offerings with premium channels and shows. We probably would have ended up going for a middle of the road package, somewhere between 50-60/month. How much have we saved every year by not paying subscription costs for our TV entertainment? Probably between 600-720! Thats a lot of money!  The good news is,  TV doesnt have to be that expensive! In fact, TV can be cheap or free! While we havent paid for cable TV, we havent exactly been deprived, or had to watch only the shows offered by the over the air networks.  There are tons of free video options out there! In fact, we actually still watch a lot of the same shows that our friends do. How do we do it you ask? Through a combination of free over-the-air digital TV,  free online video services (the legal kind) a video streaming software, super low-cost internet service, and a Xbox. Our Low Cost Home TV Setup Heres how we watch TV at our house.  Keep in mind that this package isnt free, but it is lower in cost than the above mentioned 720/year package.  Things we needed: TV:  A TV to watch your shows on!  –  Cost:  Free (you probably already have one) PlayOn Media Streaming Software:  The PlayOn software allows you to stream online video from popular services like, Netflix, Amazon Video, the big networks and a myriad of others straight to your TV through a networked media device (see below.   They also have a feature if you pay for the “Plus” version of the software that allows recording of series of shows, and automatic skipping of commercials.  They even allow you to record your favorite Netflix or Amazon shows so you can take them with you on the go (with no need for internet. Its essentially a home DVR for online video. Cost: Limited functionality free version, or one time fee of 59. 99 for lifetime license. Monthly or yearly subscriptions are also available. Networked Media Device – Like Our Xbox 360:  You can get a brand new Xbox 360 for around 100-150 nowadays, sometimes cheaper.  We just got our second one for 75 from a friend. Tons of other networked media devices are compatible as well including Ipad, Iphone, Google Chromecast,   Playstation 4, HP Mediasmart TV s, and Nintendo Wii and Roku devices. Check the link above to see if your device is supported. –  Cost:  Free-200 (depends on if you have one of these already. If you dont have one already, I recommend the uber-cheap 35 Google Chromecast  or Fire TV) Affordable Home Internet Plans –  FreedomPop offers 100% free home broadband.  There is a one time cost of 99 for their home wireless hub (act as a both a modem and rougher in one) and you get 1GB of data a month completely free. Youll need a little more data if youre into streaming videos a few times a month, but you could easily get by with their 10GB/mo plan for only 18. 99 if you only watch shows a few times a month like me. Video Streaming Services:  There are tons of online video streaming services like, Netflix,  Instant,   Philo, YouTube,  Comedy Central, HGTV, and ESPN that support the PlayOn software!  The software also now supports plugins, so additional channels are appearing all the time including the Food Network, NBA/NFL content, and others! –  Cost:  Free UPDATE: Check out my updated cord cutting package and recommendations In our case, we already had everything at our house, except for the PlayOn software.  So for this setup we paid 59. 99 for a lifetime license for the PlayOn software, plus the 8. 99/month for the basic Netflix streaming package (get it, its worth it. were also already paying for Amazon Prime, so we got free streaming TV shows and movies with that membership. The total cost was 168 for the first year, and 108 for every year after. That is a lot cheaper than if we were paying for cable! Heres a video showing how easy it is to install PlayOn. So heres how the above cited items are setup at our house in order to stream video from the web, to our TV The  PlayOn software is installed on our home computer connected to the network. Once installed  PlayOn has a media server running in the background that pulls in shows from major video content providers, and allows the PC to pull in the video streams in the same way that a web browser does. From there you can set it to record shows, record entire series, or record new episodes. Or just watch a stream live. Video is watched on the desktop via the included app, or is sent over the home network and played full screen through a connected device. In our case that means the Xbox 360, Nexus tablet, Fire TV, Samsung Galaxy Smartphone or Chromecast connected to our 50″ Plasma TV.  We can control playback via a smartphone or tablet via the PlayOn app. We can watch our shows on whatever devices we want! Heres  an explanation of how  Playon works from the softwares website: PlayOn is a streaming hub which organizes all of your favorite online streaming sites and all of your personal media into one convenient location on your PC…It offers content discovery & management and functions as a media server and online DVR all wrapped into one easy-to-use interface. Watch Free Over-The-Air HDTV The setup I talked about above is only one way to get free or low cost TV content.   Another way we get free content at home is through the free over-the-air HDTV channels that are now available to everyone who has a HDTV tuner and an antenna.  Did you know that 94 of the top 100 watched shows are shown on network television – that you can get over-the-air? If you have a TV with a built in digital tuner and a simple HDTV antenna, you should be able to just turn your TV on, do a channel scan and get all the network TV stations in their full HD glory! In fact, in many cases youll get a higher definition signal when watching over the air as they are often sent in lower definition via your cable provider. Check for your local digital stations here. Which antenna do we use? We have the Mohu Leaf 50 digital HDTV antenna  (review at the link.   We love it and we are able to pull in 35 strong channels over the air, and another 14 with a low signal! Id also recommend the SMARTenna from Channel Master. If youre one of the 10 people who still have a regular TV, youll need to buy a digital converter box to watch TV in conjunction with your antenna, and once you get one, you will then get tons of crystal clear TV stations for free!  When we switched to watching Digital TV years back we instantly gained about 5-10 TV stations because some channels have the main channel, and then sub channels as well. Honestly we could probably survive on our over the air channels alone, although my wife likes to have our cable TV fix every once in a while – which is why we have PlayOn. Watch an unboxing and setup of our digital antenna that we use to watch over-the-air TV channels here: Over-The-Air DVR If youre using an antenna like the Mohu Leaf, you can also buy an over-the-air DVR, similar to what you would use from your cable company, but with more features in some cases. Some of the better OTA DVRs include: Tablo DVR: The Tablo DVR allows you to watch live TV, record shows or record series, much like a cable company DVR. It also allows you to watch recorded shows or live TV on all your devices like set top boxes, phones, tablets, etc. A comprehensive Tablo review can be found here. Channel Master DVR+ Channel Master DVR+ will allow you to record shows or watch live TV, in addition to viewing streaming video from a variety of sources. HDHomeRun Extend Tuner & DVR: The HDHomeRun Extend is a network over-the-air tuner that will sync up with their HDHomeRun DVR software, or with a third party software like Plex to watch Live TV and record your favorite shows. All three of the ones listed above allow you to record over-the-air shows and then watch them on your TV. On the Tablo and HDHomeRun you can also stream them to a tablet, phone or the TVs in your house using devices like the Fire TV, Roku or Chromecast (Adding a Slingbox 500 to the DVR+ will accomplish the same. Definitely worth looking into if youre a cord cutter. Watch Free TV Online In addition to the options above, you can also watch TV for free through a variety of websites online.  While it isnt as fun to watch the shows on a small computer monitor, it is still a good option I think.   Many of these online options may be available for streaming through the  PlayOn software in the future as well. UPDATE: You can now watch video from any streaming website on your TV using your Google Chromecast. TV Network Websites: ABC, NBC, CBS all have good full episode streaming options available. Watch tons of movies and TV shows. :  Tons of free content in a cool online TV network format thats compatible with Chromecast and other devices. Tons of content, including TV shows! S: Im new to this one, but it looks to have lots of good free TV options. AOL Video: Both short and long video clips and full shows. There are a ton of other free video sites out there, this list only lists some of the ones I found to be the best.  Have some free online video options that you use?  Let us know about them in the comments and maybe Ill add them to the list. Rent Movies And TV Shows – And Use The Library Another low cost option to get your TV and movie fix is to either rent your TV shows and movies, or to get them from your local library. My favorite options are: Redbox:  Redbox allows you to rent a new release movie for 1 a night,  which is an extremely low cost movie rental option. Search for coupon codes online for free redbox rentals, and it can be even cheaper! Slightly more, but the added convenience of keeping the movies and TV shows as long as you want, and being able to stream a selection of movies and TV shows over the computer, or networked media device.  Netflix is getting better all the time, now with great original series like House of Cards. Amazon Instant Video: Amazon Prime members can stream hundreds of movies and TV shows included in their 79 yearly Amazon Prime membership.  Other premium or recent movies and TV shows may have a purchase or rental cost.  Amazon Instant streaming is now integrated with Xbox 360 and a variety of other media players. YouTube TV  –  44. 99/month:  This service has quickly become my favorite cable TV replacement streaming service, if you need to watch sports.  It offers a ton of channels and an unlimited cloud DVR, ability to get local and national sports channels and more. Philo TV – 20/month: Philo TV is our current favorite streaming service. We pay only 20/month and we get 50+ channels. The only catch is there is no sports or news channels included since those are some of the most expensive. Read my full Philo review here. Your Local Library: Your local library will most likely have  a decent selection of DVD movies that you can check out for a week or more.  My local library tends to be a bit picked over, but if you get on a waiting list you can usually find movies or TV shows youd enjoy watching. Borrow From Friends: Borrow movies and TV shows from friends and family.  They already own a ton of DVDs, they may as well get some use out of them! Conclusion A lot of people pay a lot of money in order to be able to watch the TV shows that they want, when they want.  In the process they end up spending upwards of 500-1000 a year, mostly for programming that they dont watch.  If they would just look a little deeper they might find that there are a lot of free or low cost options out there, and they can get a lot of the same TV shows, movies and other video content for free. My suggestion?  Read this article, do some research, and find your own low cost option for watching the TV shows that you love.  If you put a few of these tips above into practice, you can save thousands of dollars, just like we have.
